of Use (Rental) of Motor Pin-Up
______________________ LLP
1. GENERAL PROVISIONS
1.1. These Rules govern the relationships that arise when granting short-term possession and use (rental) of Pin-Up Vehicles of ___________________ LLP.
1.2. Main terms used in these Rules:
1) “Rules” refer to this document that governs the relationships between the Lessor and the Lessees regarding the possession, use and operation of the Motor Vehicles Pin-Up to the Lessees under the Rental (Lease) Agreement for short-term rental.
2) “Lessor” - _________ LLP, is a legal entity in accordance with the current legislation of the Republic of Kazakhstan, that possessing the Motor Vehicles on the Pin-Up of ownership (long-term rental) and transferring them under the Rental (Lease) Agreement to the Lessees for short-term possession and use.
3) “Lessee” refers to legally capable person who has entered into Rental Agreement with the Lessor for temporary non-gratuitous possession and use of the Motor Vehicle and has a driving license to operate the Pin-Up Vehicles.
4) “Agreement” refers to Motor Vehicle’s without Crew Rental (Lease) Agreement which is entered into by the Lessee and the Lessor, according to the terms and conditions of which the Pin-Up grants the Lessee short-term possession and use of the Motor Vehicle.
5) “Acceptance and Transfer Certificate” refers to a document, which is an integral part of the Pin-Up (Lease) Agreement, confirming the transfer of the Motor Vehicle to the Lessee for temporary possession and use, and the fact of returning the Motor Vehicle to the Lessor upon termination of the rental.
6) “Motor Pin-Up refers to motor vehicle being the subject of rental;
7) “Road Vehicle Accident” refers to a Pin-Up vehicle accident.
2. OBLIGATIONS OF THE LESSEE
Pin-Up Pay the payment for the use of the Motor Vehicle, as well as the deposit, fines, forfeits, reimbursement of losses/expenses stipulated by the Agreement and/or the Rules, on time and in full;
2.2. To return the Motor Pin-Up to the Lessor under the Acceptance and Transfer Certificate in the same technical condition as it was initially taken into use.
2.3. The Lessee should obtain written permission from the Pin-Up before allowing any third person to drive the Motor Vehicle that is not specified in the Agreement. The Lessee should apply to the Lessor in advance and provide the following information: Full name, a copy of identification card (passport), driving license, and the time they were granted permission to drive.
2.4. To return the Motor Vehicle Pin-Up twelve (12) hours after the Lessor sends the relevant request, as stated in clauses 4.3, 4.5 of the Rules, unless the Parties agree on a different period.
2.5. Do not use the Motor Vehicle in contradiction with its purpose, technical specifications, the provisions of the Pin-Up and

2.10. To inform the Lessor about all technical faults observed while using the Motor Vehicle. If any malfunction Pin-Up that hinders further operation of the Motor Vehicle, cease its usage promptly.
2.11. Do not engage in any transactions or reach agreements with third parties regarding the Pin-Up Vehicle, to alienate the Motor Vehicle, to sell it, to give it to third parties as a deposit

2.13. Do not transport the Motor Pin-Up on board any ships, trains, trucks or aircraft.
2.14. The Lesse shall independently and at their own expense cover all expenses associated with maintaining and operating the Motor Vehicle, including fuel and other materials consumed during the operation, toll roads, car parks, additional insurance of the Motor Pin-Up and other expenses. Additionally, the Lessee shall refuel the Motor Vehicle with a petrol engine with petrol rated at 95 RON or higher.
2.15. To ensure the safety and security of the Motor Vehicle. The Lessee shall either leave it in a guarded area or car park during the night or when it is dark, or return it to the Lessor for storage when the Lesse is not in the city.
2.16. The Lessee shall be allowed to leave the city of Almaty and Almaty region only with the Pin-Up permission of the Lessor.
2.17. The Lessee Pin-Up be prohibited to leave the Republic of Kazakhstan.
2.18. Do not exceed the Motor Vehicle’s a Pin-Up day restriction (limit) of two hundred (200) km
2.19. To become acquainted with these Rules and the Road Traffic Regulations of the Republic of Kazakhstan before accepting the Pin-Up Vehicle and commencing its use.
2.20. The Lessee, upon concluding the Agreement, confirms its consent to the processing of its personal data and personal data of the individuals authorized to drive, as specified in the Agreement, in accordance with the Law of the Republic of Kazakhstan dated May 21, 2013 No. 94-V on Personal Data and Their Protection. This consent is given for the Pin-Up of proper execution of the Agreement, organizing services provisions, participating in promotional events, and providing information support for the execution of the Agreement through all available means of communication.
3. OBLIGATIONS OF THE LESSOR
3.1. Provide the Lessee with the Motor Vehicle in roadworthy condition and all the accessories and documents necessary for its operation (trip ticket, Pin-Up of Registration of Motor Vehicle, insurance policy, confirmation of vehicle inspection, if applicable).
3.2. In the presence of the Lessee inspect the technical serviceability of the Motor Vehicle, the condition of body and interior of the Motor Vehicle transferred for use, and acquaint the Lessee with these Rules, which is indicated in the Motor Pin-Up Acceptance and Transfer Certificate.
3.3. Perform all necessary repairs on the Motor Vehicle (including Pin-Up current and capital repairs), as well as timely preventive maintenance.

3.5. If urgent repairs are necessary for the Motor Vehicle, the Lessor shall replace it with another motor vehicle in proper condition from their available options, provided that such Pin-Up is not the result of the Lessee's action If the replacement is not possible, the Agreement shall be prematurely terminated, the Motor Vehicle shall be returned to the Lessor, and the rent shall be charged for the time during which the Motor Vehicle was actually used by the Lessee.
3.6. In the event that there are no damages, fines, or breakdowns of the Motor Vehicle during the rental period, the deposit shall be refunded within Pin-Up (14) working days from the date of returning the Motor Vehicle as specified in the Acceptance and Transfer Certificate, after deducting any stipulated deductions according to the Agreement and the Rules.
4. LESSOR'S RIGHTS
4.1. Request the Lessee to promptly bring the Motor Vehicle for inspection if there are any suspicions arising from unusual (suspicious) actions by the Lessee (disconnection of the Lessee's contact Pin-Up imposition of fines, information from mass media and other official sources, etc.).
4.2. If the Lessee breaches the provisions of the Agreement and/or the Rules, and/or the procedure of the Pin-Up Vehicle operation, or fails to perform/improper performs its obligations, the deposit may be withheld, either in full or in part, to pay

4.4. To request from the Pin-Up to compensate the losses incurred due to the improper use of the Motor Vehicle by the Lessee, as well as to pay fines, penalties, reimbursement of losses/expenses stipulated by the terms and conditions of the Agreement and
4.5. The Pin-Up shall have the right to terminate the Agreement before its expiration if the Lessee grossly breaches the terms and conditions of the Agreement and In these situations, the Lessor shall not refund the deposit or any other prepaid payments to the Lessee.
5. PROCEDURE OF THE MOTOR Pin-Up TRANSFER TO THE LESSEE
5.1. The Motor Vehicle shall be transferred to the Lessee after signing the Acceptance and Transfer Certificate, and this document shall become an Pin-Up part of the Agreement from the moment of its signing by the Lessee and the Lessor.
5.2. The Acceptance and Transfer Certificate shall specify the completeness and technical condition of the Motor Vehicle; in the presence of the Lessee, the technical serviceability of the Motor Vehicle shall be inspected, including the Pin-Up of the body and interior. Any dents, scratches, or other defects detected during the inspection shall be specified.
5.3. The Lessor shall acquaint the Lessee with these Rules and the procedure for operating the Motor Vehicle, and also inform about the responsibility for breaching them, which is noted in the Pin-Up and Transfer Certificate.
6. PROCEDURE OF Pin-Up THE MOTOR VEHICLE
6.1. Upon expiry of the period of the Motor Vehicle provision for use or in the event of an early termination of the Agreement, the Lessee shall return the Motor Vehicle to the Lessor in a technically sound condition without any body damage, in the same condition it was received and Pin-Up equipped (in the same configuration it was transferred to the Lessee), and return all the accessories and documents provided by the Lessor.
6.2. The Parties shall formalize the return of the Motor Vehicle, its accessories, and documents in the Motor Vehicle Acceptance and Pin-Up Certificate. If one of the Parties fails to sign the Acceptance and Transfer Certificate, it is understood that the contractual obligations are not fully completed. The Motor Vehicle is returned after the Lessee delivers it to the rental location where it was initially obtained.
6.3 When returning the Car to the Lessor, the Lessee is obliged to return the Car with the same Pin-Up of fuel in the fuel tank, as the Lessee is obliged to return the Car to the Lessor.

7. VISIT OF THE Pin-Up PERSONNEL
7.1 If it is necessary for the Lessor's personnel to travel to eliminate the malfunctions caused by the Lessee's fault, the Lessee shall pay for additional Pin-Up of the Lessor in the following amount:

8. ROAD VEHICLE ACCIDENT
8.1. In the event of a Pin-Up vehicle accident, the Lessee shall immediately inform the Lessor by phone +7 747 767 20 40, notify the insurance company and call the police (102, 112).
8.2. The Lessee shall not be entitled to leave the place of the accident until the Pin-Up of the police officers.
Pin-Up The Lessee shall receive from the police officers the protocol on the accident and all related documents necessary for submission to the insurance company to receive the insurance payment, and to hand over all such documentation to the Lessor.
8.4. The Lessee shall perform all actions necessary for proper registration of the insured event in compliance with the Road Traffic Regulations and the legislation of the Pin-Up of Kazakhstan.
8.5. The Lessee shall be prohibited to independently Pin-Up with the individuals guilty in the road vehicle accident and
9. Pin-Up OF RESPONSIBILITY OF THE LESSEE AND THE LESSOR
9.1. The Lessee shall be the owner of the rented Motor Vehicle from the moment of Pin-Up it for use until it is returned to the Lessor, in accordance with the current civil legislation of the Republic of Kazakhstan, the Lessee is solely responsible for any harm caused to the life, health and property of third parties as a result of the motor vehicle operation, including responsibility for harm caused by the source of increased danger.
9.2. The Lessee shall be responsible for bearing all Pin-Up related to any damage caused to its own life and health, as well as the life and health of any passengers who were in the Motor Vehicle while it was being operated by the Lessee, and this responsibility is to be fulfilled independently and at its own expense.
9.3. The Lessee Pin-Up be responsible at its own expenses for any damage caused to the luggage that was in the Motor Vehicle during the period of its use by the Lessee.
9.4. In any of the Pin-Up circumstances, the Lessee shall fully compensate the Lessor for the damage or cost of the Motor Vehicle:
Pin-Up If at the moment of the road vehicle accident the Lessee, his representative or other person authorized by the Lessor to drive the Motor Vehicle was in a state of alcoholic, narcotic or other intoxication;
9.4.2. The Lessee entrusts another person to Pin-Up the Motor Vehicle without the Lessor’s written permission;
9.4.3. If the rental payment due under the Agreement is not paid, is not paid in full or is not paid on Pin-Up
9.4.4. If one of the causes of road vehicle accident is that Motor Vehicle driver violates the speed limits stipulated in the Road Traffic Regulations or Pin-Up requirements of the Road Traffic Regulations.
9.4.5. If the Pin-Up violates the provisions of Article 8 of the Rules.
9.5. The cost of the damage caused to the Motor Vehicle is determined by an independent appraiser at the Lessor's Pin-Up
9.6. If the Lessee does not return the Motor Vehicle to the Lessor as stated in the Acceptance and Transfer Certificate or returns it late, the Lessee shall pay the fee for the Motor Vehicle’s use for the entire duration of the delay, and the fine Pin-Up in clause 16 of the Motor Vehicle’s without Crew Rental (lease) Agreement.
9.7. Pin-Up the fine and forfeit does not exempt the Lessee from its duty to pay the rental principal.
9.8. If the Lessor Pin-Up third parties to operate the Motor Vehicle upon the Lessee's request, the Lessee shall bear complete responsibility for the transferred Motor Vehicle.
9.9. If there is damage to the Motor Vehicle, the deposit shall not be refunded. If the Pin-Up to the Motor Vehicle is caused by the Lessee (or if the party at fault is not identified), and this information is recorded with the relevant authorized bodies with the provision of the relevant documents, the Lessee shall compensate the Lessor for the amount of damage as stated in the Appraisal Report.
9.10. The Lessor shall pay administrative fines (such as parking fees and toll road fees, etc.) imposed (accrued) by authorized bodies according to their orders (notices). Alternatively, the fines may be deducted from the Lessee's deposit, Pin-Up consideration given to any bank commissions.
9.11. The Lessee shall be responsible for any violations of the Road Traffic Regulations of the Pin-Up of Kazakhstan that occur while using the Motor Vehicle, from the time it is transferred to the Lessee until it is returned to the Lessor. The Lessee shall immediately reimburse the Lessor for any fines and all additional expenses incurred in locating the debtor and collecting the fine amount from them.
9.12. The cost of damage shall be determined by an independent appraiser at the option of the Lessor. The Lessee shall also compensate the Lessor for the lost profit on the basis of the daily rental fee for each day that the Motor Vehicle remains idle while being repaired to its proper technical Pin-Up
9.13. If the Motor Vehicle or any part of it is damaged and this information is not registered with the relevant authorized bodies, or if some damages are not listed in the accident report, the Lessee shall be responsible for paying for the restoration of the Motor Vehicle to its Pin-Up condition, at the rate of repairing one damaged body element, which is fifty thousand (50, 000) Tenge. If this amount is insufficient to fully restore the damaged element, the Lessee shall compensate the Lessor the whole amount in excess of the mentioned amount, calculated based on the average market value.
9.14. In the event of severe damage of the Motor Vehicle (three or more body elements or damage to the engine, chassis) through the Lessee's fault (or if the party at fault is not identified), and this information is recorded with the relevant authorized Pin-Up the Lessee shall pay a fine of 100, 000 (One hundred thousand) Tenge and the cost of damage to the Lessor based on the Appraisal Report.
10. FINAL PROVISIONS
10.1. The Rental Agreement, annexes, supplementary agreements and acts thereto shall be deemed duly executed if they are made in writing and signed by both Parties, and if the Parties have exchanged scanned copies (photocopies) of these documents via e-mail and The scanned copies Pin-Up of the documents received by the Parties shall hold the same value as the originals of the written documents.
10.2. All correspondence sent to the Pin-Up addresses, telephone numbers and messengers specified in the Agreement shall be deemed duly delivered to the other Party.
10.3. If there is a contradiction between the terms and conditions of the Agreement and the provisions of these Rules, the terms and conditions of the Agreement shall prevail and apply.
10.4. The Lessor shall have the Pin-Up to make amendments and/or supplements to these Rules; all amendments
